Guidelines and Policies: 1. THE PROGRAM PERIOD Your Favorite Charity Program begins on Friday, May 15, 2010 at 12:00 a.m. (CT), and ends on Friday, July 30, 2010 at 11:59 p.m. (CT) (the "Program Period").
2. HOW IT WORKS Each Qualified Charitable Organization is associated with a Charity Code. The list of charity codes is here. A Qualified Charitable Organization must be: 1) a 501(c)(3) organization legally organized and recognized in the United States; 2) a public charity which files a Form 990; and 3) serve the greater Chicagoland area or Illinois. If you would like to add a Qualified Charitable Organization to the list, please submit the charityıs name to tom@prosportsexperiece.com. Pro Sports Experience, in its sole discretion, will determine whether or not the submitted charity organization is qualified. If the submitted charity is deemed qualified, Pro Sports Experience will issue a Charity Code for that organization which may then be used for the Program. Individuals and private foundations are not eligible for the Program and may not receive any charitable donations through this program. Pass the Charity Code to family, friends and acquaintances, along with details about the Chicago Bears Youth Football Camps. Any person who signs up for a Chicago Bears Youth Football Camp and submits an active Charity Code during the registration process (the ıRegistrantı) will trigger a $40 donation to that charity from the Chicago Bears Youth Football Camps. Pro Sports Experience will keep track of all registrations bearing a Charity Code. Once registration payment is made, the Charity Code is final and cannot be changed. The Charity Code must be identified at the time of registration and may not be added after registration payment is made. In the event of a Payment Plan sale, registration payment is deemed to be made at the time the first payment is processed and/or received. Registrations may be made on-line, via telephone or by mail. Registrants must pay full retail camp price for the $40 donation to trigger upon submission of the charity code. This program is not offered if any other offer or discount is used. A Charity Code may be used only one time per Registration and each Registration may have only one Charity Code. Registrations and/or Charity Codes may not be split among charitable organizations. This Program is offered only for registrations occurring during the Program Period (between May 15, 2010 at 12:00 a.m. (CT), and July 30, 2010 at 11:59 p.m.). Pro Sports Experience reserves the right to determine whether a Registration has occurred during the Program Period. In the event a camp registration is canceled with or without refund (for any reason and regardless of whether it is cancelled by the Registrant, Pro Sports Experience and/or by some other entity or circumstance), the charity donation submission will become void and the $40 donation will NOT be made to the charity. All donations will be paid by check to the charityıs legal name on or before November 30, 2010. Pro Sports Experience, the Chicago Bears Youth Football Camps (and all affiliates) are not responsible in any manner for any taxes or costs associated with the solicitation on behalf of Qualified Charities or with the Charityıs acceptance of a donation. Participants and Qualified Charities receiving donations may be required to execute and return an Affidavit of Eligibility, a Liability Release, a 1099 form, tax-related forms and/or a Publicity Release within 5 days of notification. Failure to return documents timely may result in forfeiture of the donation. By participating in this Program, the Participant irrevocably grants Pro Sports Experience, the Chicago Bears Football Club, Inc., the National Football League and each of their affiliates, subsidiaries, successors, assigns and licensees, the right to use such Participantıs name, photograph, quotations, likeness, and home town, in any and all media including but not limited to for the purposes of advertising and promoting youth football camps. Participant agrees that they shall not be entitled to any compensation for such use. In no way may the Participant, Qualified Charity and/or PSE be considered agents of, employees, partners or joint ventures with each other and no party may bind the other to any obligation.
3. LIMITATIONS ON LIABILITY By participating in the Program, all Participants agree to forever waive, release, discharge, and covenant not to sue Pro Sports Experience, the Chicago Bears, the National Football League, as well as each respective partyıs owners, employees, agents, attorneys, directors, officers, shareholders, contractors, successors, assigns and insurers (collectively "Released Parties") for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions, causes of action whatsoever, of every nature, character and description (collective, "Claims"), known and unknown, including, but not limited to, all those arising out of or in any way related to the Program; these Guidelines and Policies; Participant's e-mails and/or communications to others; the negligence of the Released Parties; the acceptance, possession, misuse or use of the donation; and any participation in the Program. In addition, each Participant acknowledges and agrees that the Released Parties are not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) incomplete, lost, late, misdirected or illegible Registrations or for failure to receive registrations due to any cause, including without limitation, human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender or otherwise, that may limit a Participantıs or Registrantıs ability to participate in the Program; or (ii) any injury or damage resulting from participation in the Program and/or the use or misuse of any donation (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the Participantıs or Registrantıs rights of publicity or privacy, or the Participantıs, Registrantıs or Qualified Charityıs claim that he or she has somehow been defamed or portrayed in a false light.)
4. Governing Law All issues and questions concerning the construction, validity, interpretation, and enforceability of these Guidelines and Policies, the rights and obligations of the Participants, Registrants and/or Qualified Charity in connection with the Program shall be governed by and construed in accordance with the laws of the state of Illinois without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
5. Invalidity/Headings The invalidity or unenforceability of any provision of these Guidelines and Policies shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Guidelines and Policies shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Guidelines and policies solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of any provision hereof.
